DC Cannabis Laws in 2026: What’s Changed Since I-71

Initiative 71 passed by ballot in November 2014 with 64.9% support, making Washington, D.C. one of the most permissive jurisdictions in the country for adult cannabis possession. More than a decade later, the law is still on the books โ€” but the landscape around it has shifted in important ways that visitors and longtime residents alike often misunderstand.

This guide walks through what I-71 actually allows, what’s changed in the years since, and which federal and local restrictions still apply in 2026.

The Core of Initiative 71 (Still Unchanged)

The statute itself is short. It legalizes, for adults 21 and older within the District of Columbia, the following:

  • Possession of up to 2 ounces of cannabis
  • Cultivation of up to six plants (only three flowering at any time) inside a primary residence
  • Transfer (gifting) of up to 1 ounce between adults 21+ as long as no money, goods, or services are exchanged for the cannabis itself
  • Possession of cannabis-related paraphernalia

What I-71 did not do is legalize commercial sales. Because of the Harris Rider โ€” a congressional appropriations restriction renewed every year since 2014 โ€” the D.C. Council cannot use local funds to set up or regulate a recreational sales market. That gap is what created the “I-71 gift economy” that Empire Buds and dozens of other operators work within.

What’s Changed Since 2014

Medical Program Expanded

The D.C. medical cannabis program existed before I-71, but in the last few years it has expanded dramatically. Self-certification was added in 2022, which means D.C. residents 21+ can register as medical patients without a doctor’s recommendation. Reciprocity for out-of-state medical cards was also broadened. Medical dispensaries can sell cannabis directly โ€” they are not bound by the gift-economy framework.

Gift-Shop Crackdowns and Adjustments

In 2023, D.C. began offering unlicensed gifting operators a path to convert into licensed medical retailers. Many established storefronts took the offer; others continue to operate strictly under I-71. Delivery-only operators like Empire Buds DC remained legal under I-71 throughout, because the law explicitly covers gifting between adults regardless of whether a delivery driver is involved.

Public Consumption Still Prohibited

This one trips up tourists most often. Despite I-71, consuming cannabis in public โ€” on a sidewalk, in a park, on the Metro, in a hotel lobby โ€” remains illegal and carries a fine. The only legal place to consume in D.C. is private property where the owner allows it.

What Federal Law Still Says

The District is unusual because so much of it is federal jurisdiction. Cannabis remains a Schedule I substance under the federal Controlled Substances Act, and federal law applies on:

  • The National Mall and Smithsonian grounds
  • All federal buildings and their grounds
  • Military installations and federal parks
  • Federal housing (HUD-subsidized buildings)
  • Federal courthouses

In practical terms, you are subject to federal law if you carry cannabis onto Mall, Rock Creek Park, or up the steps of any monument. Stay on residential or commercial D.C. land and you are subject to D.C. law.

Crossing state lines is a federal felony. Even a few grams brought into Virginia or Maryland from D.C. crosses a state border and triggers federal trafficking statutes. Cannabis you receive in D.C. must stay in D.C.

Hotels, Airbnbs, and Where to Actually Consume

This is the question we get most often, especially in Georgetown and downtown. Hotels in D.C. set their own policies, and most major chains explicitly prohibit smoking of any kind, including cannabis. Airbnbs vary host-to-host โ€” check the listing or ask before you book. Vaping is more discreet than flower, but it’s still consumption and is still bound by the property owner’s rules.

Workplace and Driving

I-71 does not protect employees from workplace drug-testing policies. Federal employees in D.C. are still subject to federal drug rules regardless of what the District allows. Driving under the influence of cannabis remains illegal and is enforced through DUI statutes.
