What Is Initiative 71?

Initiative 71 โ€” officially the Legalization of Possession of Minimal Amounts of Marijuana for Personal Use Act of 2014 โ€” was passed by D.C. voters on November 4, 2014, with 70% of the vote. It took effect on February 26, 2015.

The law decriminalized adult cannabis possession and permitted adults 21 and older to give cannabis as a gift โ€” free of charge โ€” to another adult 21 or older. Because the D.C. City Council is subject to Congressional budget oversight, lawmakers were blocked from creating a taxed retail cannabis market (the way Colorado or California operates). Instead, a vibrant gift economy emerged.

Empire Buds DC was founded in this gift economy โ€” and we take our compliance obligations seriously. We do not sell cannabis. We sell art, apparel, and accessories, and we gift cannabis to qualifying adult customers as permitted under I-71.

Adults 21+ may possess up to 2 ounces of cannabis anywhere in D.C. that is not a federal property or school.

Consuming cannabis in public spaces, vehicles, or federal buildings remains illegal under D.C. law. Use in private residences only.

How the Gift Economy Works

The D.C. gift economy operates on a simple premise: businesses may sell lawful goods โ€” art, apparel, accessories, snacks, beverages โ€” and separately gift cannabis to qualifying adult customers. No money is exchanged for the cannabis itself. Here’s how a typical Empire Buds DC transaction works:

You Browse & Select

You browse our menu and select an art item, apparel piece, or accessory. Each listing clearly shows the donation amount and what cannabis gift is associated with that item.

You Place Your Order

Orders are placed via our secure website or by contacting us directly. We confirm your D.C. delivery address and arrange a same-day delivery window.

ID Verification at Delivery

Our driver verifies your government-issued ID at the door. You must be 21+ and physically present in Washington, D.C. to receive your order. No exceptions.

You Receive Your Gift

Your purchased item and your cannabis gift are delivered together. All cannabis is lab-tested, properly packaged, and labeled. You receive no more than 1 ounce total per delivery, per I-71 limits.

What Is NOT Permitted Under I-71

Selling cannabis for money

Any direct exchange of cannabis for cash, goods, or services with an explicit tie between the two is prohibited. Only true gifting is legal.

Crossing state lines

Taking cannabis out of D.C. into Virginia, Maryland, or any other state is a federal crime regardless of the destination state’s laws.

Gifting to anyone under 21

Providing cannabis to anyone under 21 is a criminal offense. We verify ID for every single delivery, no exceptions.

Public consumption

Consuming cannabis in public spaces, parks, vehicles, or on federal property (which includes the National Mall, monuments, and federal buildings) is illegal.

Possession over 2 ounces

Possessing more than 2 ounces remains a civil and potentially criminal offense under D.C. law. We never deliver more than 1 ounce per transaction.

Consumption on federal property

Over 30% of D.C.’s land is federally controlled. Cannabis is still illegal under federal law โ€” possession on federal property carries federal penalties.
